3.      Critically interpret and evaluate the procedures relating to charter party drafting and the wording of main clauses of charter parties;

4.      Critically evaluate the necessary changes of charter party clauses in order to protect the interests of the owner / charterer;

Assessment instructions:

·         The deadline of the coursework is “8 December 2020 at 14.00 pm”.

·         The coursework is an individual report of 2000 – 2500 words.

·         The assignment must be submitted via i–learn, along with the report of the Turnitin software.

·         Harvard referencing system must be applied.

Topic

You are provided a charter party. You are required to discuss the following clauses and wording with any possible restrictions, requirements, exceptions and interpret and justify their use and application and suggest any amendments to secure the interest of the shipowner:

 

1.       Is the charter party a voyage or a timecharter? Refer to the relevant clause(s) and analyse the differences between voyage and time charterparties. (10%)

 

2.       What is the duration of the charterparty? Critically discuss the conditions of the vessel’s calling ports during the charterparty. (30%)

 

3.       Critically discuss the hire clause and all relevant clause(s) that affect the revenue of the shipowner, including off – hire clause(s) and tax clauses. Suggest any possible amendments, in order to secure a better agreement for the charterer. (30%)

 

4.       Critically discuss the relevant delivery and redelivery clauses. Suggest any possible amendments, in order to secure a better agreement for the charterer. (30%)

 

·         Do not forget to refer to the relevant number of each clause.

·         Support with arguments your amendments.

D:40-49 Questions answered with some mistakes and partially satisfying analysis, structure and presentation.
E:30-39 Inadequate answers with several mistakes, poor analysis, structure and presentation.
