The final assessment for this module is in 2 parts. The first part is a Multiple Choice Test which you will be informed about separately. The purpose of this Guidance is to provide you with details about the second part of your assessment which is the Essay.
There are 2 essay titles and you must choose ONE essay only.
Choose ONE essay title
1) What is a trust? Do you think the interests of a beneficiary under a trust are unjustifiably prioritised? Use case law to support your argument(s).
OR
2) What is the role of intention in establishing a trust? Is intention appropriate in every type of trust? Use case law to support your argument(s).

Guidance Notes:
1. The word limit is 3000 words inclusive of footnotes but excluding your bibliography.
2. You must include a bibliography.
3. Please follow the OSCOLA guide for all referencing.
4. The submission date is 24 May 2021 at 12noon via Canvas. Late submissions will attract penalties unless extenuating circumstances are granted.
5. This essay will count as 75% towards your overall grade for this module.
6. As this is a summative assessed piece of work, students must work independently on producing their answer. It is not, therefore, appropriate for teaching staff to provide individual advice and guidance on both points of law which are relevant to the assessment, and general matters relating to approaches to essay writing. If you have any questions, please post these on the module Discussion Board on Canvas, and the module leaders can then consider whether it is appropriate for guidance to be provided to all students via the Discussion Board.
7. The lectures in Week 11 will be devoted to this assessment.
8. For now, as you study this module think about which essay you would like to answer. Use the readings that we have undertaken so far to help shape your thoughts in relation to each essay (or your preferred essay).
9. You can begin conducting wider research and start to think about the arguments that you may wish to explore in order to answer one of these essay questions. Do note, however, it is only once we get to the end of the module that you will have a better understanding of how different concepts, themes, topics and issues interact
10. Whilst each essay title is quite broad in of itself you can select any aspect of what we study on this module in order to interrogate and explore the essay question. We are looking for depth rather than breadth.
